Chris Brown has side stepped a bit of jail time thanks to Superior Court Judge James R. Brandlin. At a hearing yesterday (February 3), Brown’s lawyers argued against the prosecution that since he has been admitted into rehab he has exhibited only good behavior.

Los Angeles Deputy District Attorney Mary Murray cites Breezy’s Washington D.C. case should be treated as new evidence worthy of removing the crooner from rehab and placed into jail, according to the Associated Press.

“He continues to pose an increasingly violent danger to society,” Murray wrote in a motion, naming the D.C. case and an incident in which Brown threw a brick through his mother’s car window after a therapy session. But Judge Brandlin feels the singer is making considerable progress in the treatment program.

Chris will return to court February 20.
