Fat Joe’s 2016 hit “All The Way Up” which featured Remy Ma and French Montana is now getting hit with a major lawsuit.

A Florida artist by the name of Fly Havana has filed a federal suit in New York against Fat Joe and featured artists saying that his “unreleased song” named “Infared” is similar to the hit. According to legal docs obtained by The Blast, the Florida artist pointed out the allegations from melodies, to the flow of the lyrics.

Havana pointed out in his suit that Fat Joe came across the song from a co-producer. Once “All The Way Up” hit the radio, Havana was caught by surprise. He also alleges the “Lean Back” rapper paid him a $5,000 payout, promising more.

Since then, Joe’s camp has came forward, arguing that Havana came up with a release deal for the song, denying claims he stole the song.
